Hague Court Acknowledges the Legal Possibility of Temporary Release! The Temporary Release Application of Duterte Was Postponed for Ruling!

The First Chamber of the International Court of Justice in The Hague has approved a postponement of the ruling on the temporary release request submitted by former Philippine President Rodrigo Duterte, and emphasized that a decision will only be made once further supporting documents are submitted or when the Chamber deems it appropriate.

Judge Motoc and Judge Gansu voted to postpone the decision, while Judge Lira dissented.

"The majority of judges believe that it is appropriate to defer the decision on the temporary release request until the defense takes further action on this matter, or until the Chamber deems it appropriate."

The court explained that the proceedings comply with Article 60 of the Rome Statute, which allows individuals under an arrest warrant to request temporary release while awaiting trial. However, such proceedings must be initiated by the defendant and must provide sufficient grounds to justify the release.

"The current decision should not be interpreted as pre-judging any matters yet to be determined in the proceedings related to the temporary release request."
