The Berlin Youth Wing of Germany’s Social Democratic Party (SPD) has proposed abolishing the marriage system in Germany and replacing it with cohabiting partnerships.
Currently, marriage enjoys constitutional protection under Article 6 of the Basic Law.
The motion titled “Down with Patriarchy, Even If It Feels Romantic” was submitted at the end of last month, ahead of the upcoming SPD Berlin branch conference scheduled for May 8–9.
According to Berlin’s Young Socialists (Jusos), marriage is a core institution of patriarchy that perpetuates “the oppression of women by cisgender men” and “restricts freedom and self-determination through the claim of permanence.”
“Marriage is a tool used by patriarchal, capitalist nation-states for class discrimination and racist policies,” the proposal argues.
Although the SPD Berlin Youth Wing acknowledges that “many people view marriage as a romantic bond and find happiness within it,” it maintains that “only through radical and unified transformation can liberation be achieved, overcoming heterosexual patriarchy and capitalism.”
This transformation should abolish traditional marriage along with all associated legal and tax benefits, replacing them with a cohabiting partnership model as envisioned in the motion.
To establish what they call a “community of responsibility,” individuals need only submit a joint written application to the registry office, which becomes effective upon submission.
Termination of such a partnership can be done at any time via a written application, “without requiring consent from the other party,” the young social democrats propose.
According to German media reports, the motion is unlikely to be discussed at the upcoming state party congress and will instead be postponed until 2027.
In the meantime, a YouGov poll conducted last month revealed that only 13% of respondents would vote for the SPD in a hypothetical election—marking the worst performance for the party since December 2019.
