The Senate has a significant dispute over its jurisdiction in the impeachment case of Vice President Sara!
With less than two weeks until the 20th Congress, the Senate is expected to have a conflict on the issue of jurisdiction in the impeachment case against Sara Duterte.
Senate Impeachment Court Spokesperson Tungol said that if Senator Rosa continues to push his motion requesting the 20th Congress of the Senate to reject the impeachment case against Sara Duterte, there will be an intense debate.
"Yes, we are expecting it, of course, there will be senators opposing, they will question this motion."
Tungol pointed out that this debate could be one of the threshold issues in the 20th Senate session, "this will involve what the boundaries are between senators and judges."
When asked what would happen if Rosa received a simple majority vote supporting his motion, Tungol said that this situation - as well as any potential reconsideration or judicial review motions - is already under study.
Although the Duterte camp submitted a petition to the Supreme Court questioning the validity of the impeachment procedure, Tungol said the impeachment trial will continue unless the Supreme Court issues a temporary injunction.
"In fact, the Senate Impeachment Court is independent from the Supreme Court and other government departments, therefore, the Senate does not need the approval of the Supreme Court when exercising its power to try and decide on the impeachment case."
"Without a temporary injunction, this process will continue, which does not depend on what the Supreme Court says. If a temporary injunction is issued, the Senate Impeachment Court will decide whether they will comply with it or not."
Tungol believes that although the Senate has a history of respecting the Supreme Court's rulings, it has also maintained precedents of independence in past impeachment trials, such as the case of former President Joseph Estrada.
