Petition for the revival of Paetongtarn? The House demands the Constitutional Court to re-examine due to illegal procedures in the ruling on the Prime Minister's qualifications!

On September 2, 20 members of the Thai Parliament led by Wisut Chaiyanon wrote a letter to the Speaker of the House, requesting that it submit a petition to the Constitutional Court, challenging the legality of the Constitutional Court's ruling that Paetongtarn ended her term as Prime Minister, which was decided with a 6-3 vote.

On August 24, the Constitutional Court announced the appointment of Sarawut, who will take over from Utcha Chaen, whose term has expired, to serve as a judge of the Constitutional Court starting from August 29, 2025. However, Utcha Chaen participated in the hearing and ruling on the case of Paetongtarn on the same day.

Although Article 27(2) of the 2018 Constitutional Court Procedure Act stipulates that Constitutional Court judges will continue to perform their duties until new judges are appointed, since the 17/252525 ruling is an important case determining whether the term of Prime Minister Paetongtarn should end, the fact that Utcha Chaen, who had already been replaced, participated in the proceedings and voting may raise issues regarding the legitimacy of the trial and ruling, similar to situations previously decided by the Constitutional Court to be revoked.
