The recently established Trump Presidential Library, under the U.S. National Archives and Records Administration (NARA), is the agency responsible for preserving White House records. On January 20th this year, The Washington Post submitted a request under the Freedom of Information Act (FOIA) to the Trump Library, seeking access to all private messages sent by Trump from his Twitter accounts @realDonaldTrump and @POTUS during his first presidential term. Although evidence suggests that Trump did send private messages, the Trump Library responded to The Washington Post stating, "We are unable to locate any records related to private messages sent by Trump during his first presidential term." If Trump indeed sent private messages that were not preserved, he may have violated the Presidential Records Act, which requires former presidents to transfer all records "related to or affecting the performance of constitutional, statutory, or other official or ceremonial presidential duties" to NARA—including private messages sent via any software or application. Meanwhile, the Trump administration is arguing that it does not need to comply with the Presidential Records Act.
