According to a message on the website of the Ministry of Commerce on September 5, 2024, in accordance with the Regulations of the People's Republic of China on Anti-Dumping (hereinafter referred to as the "Anti-Dumping Regulations"), on June 17, 2024, the Ministry of Commerce (hereinafter referred to as the investigating authority) issued Announcement No. 23 of 2024, deciding to initiate an anti-dumping investigation on imported related pork and pig by-products originating from the European Union (hereinafter referred to as the investigated products).
The investigating authority has investigated whether the investigated products are dumped and the extent of dumping, whether the investigated products have caused damage to the domestic industry and the degree of damage, and the causal relationship between dumping and damage. Based on the investigation results and the provisions of Article 24 of the Anti-Dumping Regulations, the investigating authority has made a preliminary determination (see Attachment 1). The relevant matters are now announced as follows:
One, Preliminary Determination
The investigating authority has preliminarily determined that the imported related pork and pig by-products originating from the European Union are dumped, the domestic industry has suffered material damage, and there is a causal relationship between the dumping and the material damage.
Two, Collection of Deposit
According to the provisions of Articles 28 and 29 of the Anti-Dumping Regulations, the investigating authority has decided to implement temporary anti-dumping measures in the form of deposit. Starting from September 10, 2025, importers importing the investigated products shall provide the corresponding deposit to the Customs of the People's Republic of China according to the deposit rates for each company determined by this preliminary determination.
The specific description of the investigated products is as follows:
Scope of Investigation: Related pork and pig by-products imported from the European Union.
Name of the Investigated Products: Related Pork and Pig By-Products.
English Name: Certain Pork and Pig By-Products.
Description of the Product: The investigated products are products obtained after the slaughter and processing of pigs, including fresh, chilled, frozen pork; fresh, chilled, frozen edible offal of pigs; fresh, chilled, frozen, dried, smoked, salted or pickled, unrendered or extracted by other methods, fat without lean meat, pig fat; fresh, chilled, frozen, dried, smoked, salted or pickled whole or cut pieces of pig intestines, bladders and stomachs.
Main Use: Suitable for human consumption.
This product is classified under the Tariff Schedule of the People's Republic of China: 02031110, 02031190, 02031200, 02031900, 02032110, 02032190, 02032200, 02032900, 02063000, 02064100, 02064900, 02091000, 05040011, 05040014, 05040029, 05040090. Among these tariff numbers, non-pig products under 05040029 and 05040090 are not included in the scope of this investigation.
The deposit rates imposed on each EU company are listed in this announcement's Attachment 2.
Three, Method of Collecting Deposit
Starting from September 10, 2025, importers importing related pork and pig by-products originating from the European Union shall provide the corresponding deposit to the Customs of the People's Republic of China according to the deposit rates for each company determined by this preliminary determination. The deposit shall be levied on the basis of the customs-determined tax price of the imported goods, and the calculation formula is: Deposit Amount = (Customs-Determined Tax Price of Imported Goods × Deposit Collection Rate) × (1 + Import Link Value-Added Tax Rate).
Four, Comments
Stakeholders may submit written comments to the investigating authority within 10 days from the date of publication of this announcement.
