India, a vast country, has all sorts of things. Indian media reported on the 30th a "reversal" case: the High Court of Uttarakhand rejected a rape case involving a man and a woman.
In 2023, the woman filed a police report accusing this man (who was then a captain) of repeatedly raping her and promising to marry her, but later broke his promise.
It is known that the two met through a dating application while this male officer was stationed in Dehradun.
After the woman complained, the local police department opened an investigation according to Section 376 (Rape), Section 504 (Intentional Insult) and Section 506 (Criminal Threat) of the Indian Penal Code, and the case was heard in the court of the Chief Judicial Magistrate (CJM).
However, later both parties submitted a joint settlement application, stating that they had reached a "compromise." The man is currently serving in another state. When the woman admitted their previous relationship and explained that misunderstandings between them led to the current situation, the case took a turn, prompting the woman to file a new application.
Both parties said: "We now want to be together again, but we cannot do so before the litigation process is completed."
Both parties stated that they intend to withdraw from all criminal proceedings and resolve the matter.
Regarding this, the local Indian court said that if both parties reach a friendly settlement and are willing to "restore harmony," the criminal prosecution can be dismissed.
In the latest opinion of Judge Ashish Naitani, it states, "Considering the facts and circumstances of the case, this court believes that only by dismissing the entire criminal proceedings being heard by the CJM court can judicial justice be achieved. Therefore, the joint application is allowed. Therefore, all legal proceedings against this army officer are hereby dismissed."
