Former Philippine President Duterte has shown cognitive impairment and is no longer capable of standing trial!
Duarte's defense lawyer, Kaufman, stated that due to cognitive impairments in multiple areas, his client is no longer able to be tried at the International Court of Justice in The Hague.
In a defense submission submitted to the First Pre-Trial Chamber of the International Court on September 11, Kaufman requested that the chamber indefinitely postpone the hearing, as Duarte's health condition will not improve.
"Mr. Rodrigo Roa Duterte is unfit for trial due to cognitive impairments in multiple areas, and Mr. Duterte's condition will not improve. Therefore, the pre-trial chamber must indefinitely delay all legal proceedings in his case."
Kaufman stated that there is no need for additional medical examinations of the elder Duterte, as he has already provided and shared with the prosecution and the Office of the Prosecutor for Victims a sufficient amount of medical information.
"All organized medical information leads to an overwhelming conclusion: Mr. Duterte suffers from severe cognitive deficits, affecting his memory, daily executive functions, visual construction ability, and orientation to place and time, while limiting his ability for complex reasoning."
"These cognitive deficits were not only diagnosed by two defense experts, but also by a neuropsychologist designated by the medical officer at the International Court's detention center upon the specific request of the clerk. For this reason, the medical data submitted to the pre-trial chamber is neither partisan nor self-serving."
This unnamed neuropsychologist found that the elder Duterte lacks the ability to remember, absorb, and apply information, and is unable to provide effective instructions to his lawyers.
"He will be unable to fluently recall information related to the period of the case, such as testifying. In short, Mr. Duterte will be unable to meaningfully participate in the legal proceedings and is unfit for trial."
