In order to safeguard national sovereignty, security, and development interests, based on relevant laws such as the "Foreign Trade Law of the People's Republic of China," the "National Security Law of the People's Republic of China," and the "Anti-Foreign Sanctions Law of the People's Republic of China," the Irresponsible Entity List Working Mechanism, in accordance with Articles 2, 8, and 10 of the "Provisions on the Irresponsible Entity List," has decided to include Shield AI, Inc., Sierra Nevada Corporation, Cyberlux Corporation, Edge Autonomy Operations LLC, Group W, and Hudson Technologies Co. among six entities on the Irresponsible Entity List and take the following measures:
One, prohibit the above-mentioned enterprises from engaging in import and export activities related to China;
Two, prohibit the above-mentioned enterprises from making new investments within the territory of China.
For matters not covered in this announcement, the "Provisions on the Irresponsible Entity List" shall apply.
This announcement shall come into effect at 12:01 a.m. on April 10, 2025.
According to reports on the Ministry of Commerce's website, on April 9, a spokesperson for the Ministry of Commerce answered questions regarding the inclusion of six American enterprises on the Irresponsible Entity List.
Question: This time, China has again activated the "Irresponsible Entity List" to impose sanctions on six enterprises involved in arms sales to Taiwan. What are the considerations?
Answer: In recent years, the six companies including Shield AI, Inc. and Sierra Nevada Corporation have ignored China's strong opposition and either participated in arms sales to Taiwan or conducted so-called military technology cooperation with Taiwan, seriously damaging China's national sovereignty, security, and development interests. Based on relevant laws such as the "Foreign Trade Law of the People's Republic of China," the "National Security Law of the People's Republic of China," and the "Anti-Foreign Sanctions Law of the People's Republic of China," and according to Article 2 of the "Provisions on the Irresponsible Entity List," China has lawfully pursued their unlawful responsibilities.
China has always handled issues concerning the Irresponsible Entity List prudently, targeting only a very small number of foreign entities that endanger our national security. Foreign entities that act honestly and legally need not worry. The Chinese government welcomes enterprises from all over the world to invest and operate in China and is committed to providing a stable, fair, and predictable business environment for law-abiding foreign-invested enterprises operating in China.
