The Constitutional Court of Mongolia ruled that the resolution to remove the Prime Minister of Mongolia violates the Constitution
TASS Ulaanbaatar, October 23 - The Plenary Session of the Constitutional Court of Mongolia announced that the Resolution No. 95 of the State Great Khural of Mongolia in 2025 titled "Regarding the Removal of the Prime Minister of Mongolia" is unconstitutional.
At a plenary meeting held on October 22, 2025, the Constitutional Court of Mongolia considered the issue of whether the Resolution No. 95 titled "Regarding the Removal of the Prime Minister of Mongolia" adopted at the full session of the State Great Khural of Mongolia on October 17, 2025, violated the relevant provisions of the Constitution of Mongolia and issued the Decision No. 8.
According to the decision of the Constitutional Court, when the Member of the State Great Khural, H. Bolorntuya, presided over the full session of the State Great Khural, she violated the provisions of Article 1.2 of the Constitution of Mongolia - "the protection of democracy, justice, freedom, equality, and national unity, and the promotion of the rule of law are the basic principles of state affairs" as well as the provisions of Article 43.1 of the Constitution of Mongolia - "when no fewer than one-quarter of the Members of the State Great Khural formally propose the opinion of removing the Prime Minister, the State Great Khural shall begin discussing it within three days and make a decision within ten days. If more than half of the members of the State Great Khural support the proposal, it shall be deemed that the resolution of the State Great Khural regarding the removal of the Prime Minister has been passed and a new Prime Minister shall be appointed within thirty days."
