However, Judge Sarokin ruled that the fee was not a fine but rather a tax, and the president cannot impose taxes without congressional authorization; neither the Department of State nor U.S. Citizenship and Immigration Services (USCIS) can enforce it. Judge Sarokin was appointed by President Obama.
