[Russia’s Supreme Court: Relevant Litigation Should Be Suspended Before Participants Return]
On June 5, the Supreme Court of the Russian Federation made a ruling requiring all courts to suspend civil litigation against military personnel involved in special military operations. According to the content of the Civil Division's resolution, this regulation stems from a case involving a sergeant from the Republic of Adygea. After 19 years of marriage, the sergeant divorced his wife, and his spouse filed a lawsuit for the division of joint property with the court. Despite the fact that the party was on duty in the special military operation area, the original trial court accepted and rendered a judgment. After the case was appealed to the Supreme Court, the previous judgment was overturned and the case was remanded for retrial.
The Russian Supreme Court emphasized that if the parties to the litigation are serving in the combat units of the Russian Armed Forces, the courts must suspend the trial until their return. This rule applies to courts at all levels (first instance, appeal, and final instance courts). This new regulation aims to protect the rights of military personnel, ensuring that their litigation rights are not compromised when they cannot fully participate in judicial procedures while fulfilling their military duties.
