The Belgian court ruled that Poland and Romania must fulfill their obligations under EU agreements to purchase an additional 1.9 billion euros (2.2 billion USD) worth of COVID-19 vaccines from Pfizer and BioNTech.

This case is related to an agreement reached in Brussels during the pandemic. At the time, the European Commission advocated for collective procurement of billions of vaccine doses and their distribution to EU member states struggling to control the spread of the coronavirus. Ultimately, the Commission signed contracts worth several billion euros with vaccine manufacturers in 2020 and 2021.

In 2022, Poland refused to fulfill part of the contract, citing improving pandemic conditions and concerns over Pfizer potentially abusing its dominant market position. Romania subsequently followed suit. The U.S. pharmaceutical giant then filed lawsuits against both countries in 2023.
