The appellate court upheld the previous judgment of the Court of International Trade (CIT) with a vote of 7 to 4, pointing out that the Trump administration failed to prove that these tariffs had a direct connection to the so-called "national emergency."

The court essentially indicated that without Congress's approval, the president cannot arbitrarily impose tariffs on the world. However, this ruling has not yet taken effect, and it will officially be executed on October 14, which also gives the Trump team a window to appeal to the Supreme Court. However, this judgment does not affect the tariffs imposed by the Trump administration under other rules, such as the aluminum and steel tariffs imposed under Section 232 of the Trade Expansion Act.
