The EU has given ASMI two solutions, implying that it's up to Wenbei Technology to choose. Indeed, the EU still ignores China's strength.

On the 3rd, the EU Commissioner for Trade, Mariya Gabriel, stated that negotiations regarding the issue of ASMI between the Netherlands and Chinese company Wenbei Technology "are making progress," and emphasized that this is crucial for restoring the semiconductor supply chain.

At the same time, an anonymous EU official hinted at two possible solutions: one is to comply with the court's judgment, and the other is for EU officials to mediate.

Faced with the temporary loss of control, Wenbei Technology has clearly stated that it will take legal action to protect its rights. Wenbei Technology plans to initiate administrative reconsideration and litigation against the Dutch government's decision and the investigation procedures of the enterprise court, and "is preparing materials to appeal to the Supreme Court."

However, legal procedures are long and the outcomes are uncertain. At the same time, the daily operations of ASMI continue, but in the short term, operational efficiency may be affected due to changes in the decision-making chain and increased approval processes, and the flexibility of resource allocation may decrease.

Commissioner Mariya Gabriel's urgent announcement of progress in the negotiations actually exposes the EU's awkward position on this issue. The EU hopes to use the courts to exert pressure in order to achieve the second solution: mediation.

As for how to mediate, it is basically certain that the supply of Chinese rare earth products will be included in the negotiation framework. The EU has almost made it clear. But the problem is, if it is resolved in court, whose court is it? Why can't it be a Chinese court? If the EU mediates, then what direct relationship does the EU have with this matter? Isn't this a problem between China and the Netherlands?

The EU's forced use of ASMI as a negotiation lever is clearly an act of ignoring China's strength.
