Long Dan emphasized that although he requires Zaldy to appear in court to answer the charges against him, he has not seen any verified formal complaints against Zaldy even at the Ombudsman's Office.

"Criminal investigations must be initiated by complaints. Have you seen the complaints? When I say complaints, I mean things that have been sworn under oath. The only thing I've heard is that the Infrastructure Committee has submitted its preliminary investigation results to the investigator, and I don't think that is an oath, so I don't think it is a complaint."

Long Dan also believes that the ombudsman, Remulla, has already "pre-judged" the case, and the statement of the Public Works Minister, Vince Dizon, supports this view, that 60 people will be jailed before Christmas.

"In this situation, submitting a counter-affidavit really has no tactical benefits, so the answer is, at this time, in the way things are going, no, Zaldy does not plan to submit a counter-affidavit."
