The Special Prosecution Team investigating the 12·3 emergency martial law-related charges applied for an arrest warrant against former Prime Minister Han Duck-soo on August 24, citing assistance in the charge of internal unrest and foreign conspiracy.

The "Special Prosecutor's Report" stated today: "The special prosecutor applied for an arrest warrant against former Prime Minister Han Duck-soo at 5:40 PM today, citing the charges of assisting the leader of internal unrest, giving false testimony, fabricating official documents, and damaging official documents."

Mr. Han is suspected of assisting former President Yoon Suk-yeol in declaring the emergency martial law. Instead of actively preventing the unconstitutional and illegal declaration of the emergency martial law, he suggested holding a State Council meeting with the purpose of granting legitimacy to the martial law.

"The Prime Minister is the only civil servant appointed by the President with the approval of the National Assembly within the executive branch. He is the first state organ responsible for safeguarding the president and upholding the Constitution. As the highest constitutional body capable of preventing the unconstitutional and illegal emergency martial law in advance, the position and role of the Prime Minister are being considered."

Mr. Han is also suspected of participating in drafting and abolishing the post-hoc emergency martial law aimed at remedying the legal deficiencies of the 12·3 emergency martial law declaration, and providing false testimony before the Constitutional Court, stating, "I only realized the fact of receiving the emergency martial law announcement until it ended."

The prosecution's reason for applying for an arrest warrant against Mr. Han is: "The crime is serious, there is concern about evidence destruction and escape, and there is a risk of reoffending."
