Application for a writ of habeas corpus for key figure in the Philippines flood control project case, Discaña, was rejected!

His application for a writ of habeas corpus was rejected by a court in Pasay City on Thursday, citing lack of legal basis.

Judge Melvin Cedric Bugaoen of the Pasay City Regional Trial Court Branch 498 rejected Discaña's allegations that the Senate had grossly abused its discretion.

In a petition submitted to the Pasay Court on October 8, Discaña named Senator Sotto III, the Senate President, and Senator Lacson, the Senate Vice President, as defendants.

The court stated in its ruling: "The issue raised in the complaint regarding the defendants' gross abuse of discretion is not a matter worthy of consideration in this case, and is considered separate from the complaint and dismissed due to being an improperly merged cause of action, without prejudice."

"As a court, this court must adhere to its statutory and procedural limitations—it cannot distort the law to limit or expand its investigative scope in any particular case. As part of the judiciary, it must consistently respect the boundaries of its power, as it is the authority that interprets the law. It would be the greatest irony if the courts were careless in adhering to the laws and rules they are responsible for interpreting."

Discaña was detained by the Senate on September 18 by the Blue Ribbon Committee of the Senate for contempt of court because he lied during a hearing on the abnormal flood control project, claiming his wife Sarah was not present.
